Timelines

Tennessee probate takes longer than Arkansas probate

A typical uncontested Tennessee estate runs 9 to 18 months. Two things drive that: creditors generally get four months from the first published notice to file claims, and the estate needs a TennCare release before the court will let it close.

The good news is that selling the house usually doesn't have to wait for the estate to close. Once the court issues Letters, the personal representative can often contract to sell — immediately if the will grants a power of sale, or after a petition if it doesn't.

Not legal advice

Before taking any action based on this information, consult with your probate attorney or your county's probate court. Laws change and individual circumstances vary.

Jurisdiction: Tennessee estates are governed by Tennessee law — principally Title 30 (administration of estates) and Title 31 (descent and distribution) of the Tennessee Code — plus the local rules of the county probate court where the person who died was domiciled. Arkansas deadlines, forms, and small-estate limits described elsewhere on this site do not apply to a Tennessee estate.
